Terms of Service

1. Agreement to Terms

By engaging JMK Automations LLC ("Company," "we," "us") for any services, you ("Client") agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

JMK Automations LLC provides marketing automation, CRM setup, lead generation systems, and related digital services for home service businesses. The specific scope of work will be outlined in a separate proposal or statement of work agreed upon by both parties.

3. Payment Terms

All fees are due as specified in your proposal or invoice.

A non-refundable deposit (typically 50%) is required before work begins.

Remaining balance is due upon project completion or as outlined in your agreement.

Invoices not paid within 14 days of the due date are subject to a 1.5% monthly late fee.

JMK Automations LLC reserves the right to pause or terminate services on accounts with outstanding balances

4. Refund Policy

Due to the custom nature of our work, all deposits are non-refundable. If a project is cancelled after work has begun, the Client is responsible for payment of all work completed up to the cancellation date.

5. Client Responsibilities

The Client agrees to:

Provide timely access to necessary accounts, assets, and information.

Review and provide feedback within agreed-upon timeframes.

Ensure all content and materials provided to JMK Automations LLC are owned by or licensed to the Client.

Delays caused by the Client may affect project timelines and do not constitute grounds for a refund.

6. Intellectual Property

Upon receipt of full payment, the Client owns all deliverables created specifically for them. JMK Automations LLC retains ownership of any proprietary tools, templates, systems, or processes used in delivering services.

JMK Automations LLC reserves the right to display completed work in its portfolio unless the Client requests confidentiality in writing.

7. Confidentiality

Both parties agree to keep confidential any proprietary information, business strategies, or client data shared during the engagement. This obligation survives termination of the agreement.

8. Limitation of Liability

JMK Automations LLC is not liable for:

Loss of revenue, leads, or business resulting from the use or non-use of our services.

Third-party platform outages, changes, or policy updates (e.g., GoHighLevel, Google, Meta).

Results that depend on factors outside our control, including market conditions or Client follow-through.

Our total liability to the Client shall not exceed the total fees paid in the 30 days prior to the claim.

9. No Guarantee of Results

We provide automation systems and marketing infrastructure. While we aim to deliver measurable improvement, JMK Automations LLC makes no guarantee of specific results, including revenue, leads, or conversions.

10. Termination

Either party may terminate the engagement with 14 days written notice. The Client is responsible for payment of all work completed up to the termination date. JMK Automations LLC may terminate immediately for non-payment or breach of these terms.

11. SMS & Communication Consent

By providing your phone number, you consent to receive SMS messages from JMK Automations LLC related to your project, appointments, and updates. You may opt out at any time by replying STOP. Standard message and data rates may apply.

12. Governing Law

These Terms are governed by the laws of the State of Georgia. Any disputes shall be resolved in the courts of Georgia, and both parties consent to jurisdiction there.

13. Changes to Terms

JMK Automations LLC reserves the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
